2. Service Description

Langmail is an email management service that connects to your Gmail account to provide email filtering, categorization, and summarization using AI. By using Langmail, you agree to these terms.

3. Account Registration

You must be at least 18 years old to use Langmail. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Subscription and Payment

Langmail offers free and paid subscription plans. Paid subscriptions are billed monthly or annually as selected. Prices include VAT where applicable. We will notify you of price changes at least 30 days in advance.

5. Right of Withdrawal

If you are a consumer in the EU, you have the right to withdraw from this contract within 14 days without giving any reason. To exercise this right, send a clear statement to info@usemarbles.com. You can use the model withdrawal form below but it is not obligatory.

By requesting immediate access to the service and acknowledging that you lose your withdrawal right once the service is fully performed, you consent to waive this right upon full performance.

6. Contract Duration and Cancellation

Subscriptions renew automatically. You may cancel at any time with one month's notice to the end of your current billing period. After any initial term, you may cancel monthly. To cancel, use the cancellation function in your account settings or email us. We will confirm your cancellation immediately by email.

7. Acceptable Use

You agree not to:

• Violate any laws or third-party rights
• Use Langmail to send spam or malicious content
• Attempt to access other users' accounts or our systems
• Reverse engineer or copy the service
• Use Langmail in a way that violates Google's API Terms of Service

We may suspend or terminate accounts that violate these rules.

8. Google API Usage

Langmail accesses your Gmail data through the Google API. Your use of Gmail data through Langmail is subject to Google's Terms of Service. We comply with Google's API Services User Data Policy, including the Limited Use requirements. See our Privacy Policy for details.

9. Intellectual Property

Langmail and its content, features, and functionality are owned by us and protected by copyright and other laws. You retain ownership of your email content. By using Langmail, you grant us a limited license to process your emails solely to provide the service.

10. Warranty

We provide Langmail in accordance with the statutory warranty provisions for digital products under German law (§§327 ff. BGB). If the service does not conform to the contract, you have the right to demand that we bring it into conformity within a reasonable time.

11. Liability

We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, and under the Product Liability Act.

For slight negligence, we are only liable for breach of essential contractual obligations, limited to foreseeable, typical damages. Essential contractual obligations are those whose fulfillment enables the proper execution of the contract.

We are not liable for damages caused by interruptions or errors in third-party services (including Google or Mistral AI) beyond our control.

12. Data Protection

We process your personal data in accordance with our Privacy Policy at langmail.me/privacy and applicable data protection laws including GDPR.

13. Changes to These Terms

We may update these terms with at least 30 days' notice by email. Continued use after changes take effect constitutes acceptance. If you do not agree, you may cancel your subscription.

14. Dispute Resolution

For consumers in the EU: The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Governing Law and Jurisdiction

These terms are governed by German law. For consumers, mandatory consumer protection laws of your country of residence remain applicable. For business users, the courts of Munich have exclusive jurisdiction.

16. Severability

If any provision of these terms is invalid, the remaining provisions remain in effect.
